1. Introduction

“Računarsko programiranje GUGUNOVIĆ Saša Gugunović s.p. Kozarska Dubica” company (“we“, “our“, or “us“) operates Marathon Photos Finder, a platform that enables race organizers to host and manage their event photos, allowing participants to easily find their race photos through advanced search technology.

THE FOLLOWING TERMS AND CONDITIONS CONSTITUTE A LEGAL AGREEMENT (THE “AGREEMENT“) BETWEEN YOU AND “Računarsko programiranje GUGUNOVIĆ Saša Gugunović s.p. Kozarska Dubica” company (“the Company“, “we“, “our“, or “us“).

BY USING THE MARATHON PHOTOS FINDER SERVICE, YOU INDICATE YOUR ACCEPTANCE OF THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS, PLEASE EXIT OUR SERVICE.

2. Definitions

Service
The Marathon Photos Finder platform, website, and related services.
User
Any individual who accesses or uses the Service.
Event Organizer
Organizations or individuals who subscribe to our service to host and manage their race photos.
Runner
Individuals who search for their photos using their bib numbers.
Content
Photos, images, text, and other materials uploaded to or available through the Service.
Subscription Plan
The pricing tier selected by Event Organizers based on their photo volume needs.

3. Account Registration and Authentication

3.1. Authentication Method

The Service exclusively uses Google authentication for user registration and login.

We collect only the following information from your Google account:

  • Username
  • Email address
  • Profile picture

You must have a valid Google account to use the Service.

3.2. Account Responsibilities

  • • You are responsible for maintaining the security of your Google account
  • • You agree that all activities under your account are your responsibility
  • • You must immediately notify us of any unauthorized use

4. Event Organizer Terms

4.1. Registration and Subscription

  • • Event Organizers must create an account using Google authentication
  • • Subscription plans are based on photo volume requirements
  • • Payment information must be provided for event activation
  • • All payments for subscription plans are processed through our third-party payment provider, Paddle.com. By making a payment, you also agree to Paddle's terms and conditions.

4.2. Photo Management and Rights

  • • Event Organizers retain all rights to their uploaded photos
  • • Organizers are responsible for obtaining necessary photo rights and releases
  • • We provide hosting and search technology only
  • • Organizers must ensure they have the right to distribute photos to runners

4.3. Pricing Terms

  • • Pricing is based on total photo volume hosted
  • • Subscription fees are billed according to the selected plan
  • • Additional storage can be purchased as needed
  • • Unused storage does not get refunded or rolled over to the next race event

All financial transactions for our services are securely processed by Paddle.com, our designated Merchant of Record. We do not store your full credit card information on our servers. Please review Paddle's own terms and privacy policy for information on how they handle your payment data.

5. Photo Access Terms

5.1. Photo Quality

Our platform supports:

  • High-resolution image hosting
  • Maximum width of 1920 pixels
  • 90% quality compression for optimal loading

5.2. Runner Access

Runners can:

  • Search photos using bib numbers
  • Download photos at full resolution
  • Search photos by scanning face

7. Platform Usage and Technical Terms

7.1. Photo Hosting

  • • Photos are stored securely on our servers
  • • Regular backups are maintained
  • • Access speed may vary based on user location and file size

7.2. Image Quality Guarantee

We guarantee that purchased photos will meet:

  • Maximum width of 1920 pixels
  • 90% of original quality
  • Free from watermarks

Contact us within 7 days if specifications are not met.

7.4. Technical Issues

  • • Technical issues must be reported within 7 days of purchase
  • • We reserve the right to rectify any technical errors
  • • Refunds may be issued only for technical faults under our control

8. Disclaimers

THE SERVICE AND ITS CONTENT ARE PROVIDED “AS IS” AND WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9. Limitation of Liability

The Company shall not be liable for any damages including:

  • Lost business or profits
  • Direct, indirect, incidental, or consequential damages
  • Compensatory, exemplary, special or punitive damages
  • Unauthorized access to servers and/or personal information
  • Interruption or cessation of transmission

10. Indemnification

You agree to indemnify the Company against losses from:

  • Unauthorized use of photos
  • Breach of these Terms
  • Violation of applicable laws

11. Changes to Terms

  • • We reserve the right to modify these Terms at any time
  • • Continued use after changes constitutes acceptance

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Bosnia and Herzegovina, specifically the Republic of Srpska, without regard to its conflict of law provisions.
